Terms of Service

1. About these terms

These Terms of Service (“Terms”) are an agreement between you and Leads Agency SRL, cédula jurídica 3-102-759132, a Costa Rican company that operates the website dentaltourismcr.comunder the brand name “Dental Tourism CR” (referred to as “DTCR”, “we”, “us”).

By using the service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. What DTCR is and what it is not

DTCR is an online marketplace that connects international patients with verified dental clinics in Costa Rica. We provide:

  • A matching tool that suggests clinics based on a quiz the patient completes.
  • A messaging inbox where the patient and the clinic can exchange information, share documents, and receive a quote.
  • A verified review system that publishes patient feedback after treatment.
  • A clinic profile system that displays verified business information to patients.

DTCR is not:

  • A dental provider. We do not own clinics, employ dentists, or perform any medical procedure.
  • A medical advisor. Nothing on the platform is medical advice. Always consult a licensed dentist for your specific situation.
  • A payment processor. We never receive, hold, or transfer funds between patients and clinics. The patient pays the clinic directly using whatever payment method the clinic accepts.
  • A guarantor of clinical outcomes. The treatment relationship is solely between you and the clinic you choose.

3. Eligibility

You must be at least 18 years old to create an account or request a quote. If you need dental care for a minor, a parent or legal guardian must use the platform on the minor’s behalf and is responsible for treatment decisions. Clinics are responsible for confirming a parent or guardian is involved before treating any patient under 18.

4. Accounts

  • You can browse clinic profiles and complete the matching quiz without an account. To send a message or receive a quote, you must create an account.
  • You are responsible for keeping your password confidential and for any activity on your account.
  • Provide accurate information. False, misleading, or impersonating information can result in account suspension.
  • You can delete your account at any time by emailing privacy@dentaltourismcr.com. See the Privacy Policy for what we retain after deletion.

5. How matching and quotes work

  • You complete a short quiz; we suggest up to three clinics that fit your case. The matching score is based on treatment capability, budget fit, verified reviews, response performance, and other factors documented on our About page.
  • Rankings on the platform are determined exclusively by verified data and never by payment for placement.
  • If you contact a clinic, the clinic has 24 hours to respond before the lead may be routed to another clinic.
  • Quotes a clinic sends through the platform are written, itemized, and valid for the period stated on the quote (default 30 days).
  • Accepting a quote on the platform means you intend to proceed with that clinic. The treatment plan, schedule, and final price are then arranged directly between you and the clinic.

6. Patient obligations

  • Provide accurate information in the quiz, in conversations, and in any documents you upload (such as x-rays, medical history, dental records).
  • Evaluate the clinic, the dentist, and the proposed treatment plan before traveling or paying any deposit. We surface verification data, but the final judgment is yours.
  • Pay the clinic directly for any treatment received. DTCR does not invoice patients and does not collect patient funds.
  • Treat clinics and their staff with the same courtesy you would expect for yourself.

7. Clinic obligations

  • Operate under all applicable Costa Rican licenses and regulations, including registration with the Colegio de Cirujanos Dentistas de Costa Rica.
  • Respond to new leads within 24 hours through the platform inbox.
  • Provide written, itemized quotes that fully disclose what is and is not included.
  • Honor any post-treatment guarantee published on your DTCR profile (minimum 12 months).
  • Maintain implant brand partnerships consistent with what is published on your profile (Nobel Biocare, Straumann, Zimmer Biomet, or equivalent).
  • Refrain from contacting patients off-platform until a quote has been accepted, unless the patient initiates the off-platform contact.
  • Submit only photos, certifications, and credentials that are real, current, and properly licensed.
  • If you import an existing patient of yours into the platform, you warrant that you have a lawful basis to share their information with DTCR. You act as the data controller for that patient’s information; DTCR acts as your processor.

8. Fees, commission, and subscriptions

The service is free for patients. Patients pay clinics directly for any treatment they accept; DTCR does not receive, hold, or process those funds.

Clinics pay DTCR in two ways:

  • Commission per accepted quote. When a patient accepts a clinic’s quote, DTCR invoices the clinic a commission calculated as a percentage of the accepted quote total. The percentage depends on the clinic’s subscription tier: 10% on Basic, 8% on Pro, 6% on Elite. If a Pro or Elite clinic falls behind on their subscription, the Basic rate (10%) applies to new quotes until the subscription is current. Tier and current rate are published on the /clinics/join page.
  • Optional monthly subscription. Pro and Elite tiers carry a flat monthly fee ($149 and $399 respectively). Subscriptions unlock features such as priority placement (within the score-based ranking, never bypassing it), advanced analytics, and dedicated account management. Basic tier has no monthly fee.

Both commission invoices and subscription invoices are billed by DTCR to the clinic separately from the platform: the clinic receives an invoice from us by email and pays via wire transfer or SINPE. We do not run subscription cards through the platform and do not see clinic banking credentials. Late payment of commission or subscription invoices may result in suspension of the listing.

9. Reviews

  • Patients who completed treatment through the platform receive a review request 30 days and again 6 months after their treatment date.
  • Reviews are published with the patient’s first name, last initial, and origin city. We do not publish full names or contact information.
  • We verify that each published review comes from a patient whose conversation reached the “completed” or “payment uploaded” status on the platform.
  • We do not edit reviews to favor any clinic. We may reject a review that contains harassment, slurs, or unrelated content. Clinics may publicly respond to a review but cannot delete it.
  • If you believe a review is false or defamatory, contact us with evidence; we investigate every report.

10. Content you submit

When you submit content to DTCR (messages, files, reviews, clinic profile data), you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, resizing images), and display it as needed to operate and promote the service. You retain ownership of your content. You represent that you have the right to grant this license and that the content does not infringe anyone else’s rights or violate any law.

11. Acceptable use

Don’t use DTCR to:

  • Send spam, phishing, or any unsolicited promotional content.
  • Impersonate another person, clinic, or organization.
  • Upload malware, exploit code, or content designed to harm the platform or its users.
  • Scrape, copy, or reuse our content without written permission. Public clinic profiles, blog posts, treatment guides, and review text are protected by copyright.
  • Reverse-engineer, decompile, or attempt to derive the source code of the platform.
  • Bypass our rate limits, circumvent the verification process, or use automated tools to interact with the platform other than well-behaved search engine crawlers.
  • Engage in any activity that violates Costa Rican law or the law of the user’s country.

12. Suspension and termination

We may suspend or terminate any account that violates these Terms, that submits false information, or that creates a risk for other users or for the platform. We may also remove any clinic that fails verification, falls below quality standards, or accumulates verified complaints regardless of commission or subscription paid. Where reasonable, we’ll give notice and a chance to fix the issue first.

13. Disclaimers

The service is provided “as is” and “as available”. We do not warrant that the matching algorithm will identify the best possible clinic for your case, that quotes will match the final cost of treatment, that any specific outcome will result from a procedure, or that the platform will be free from errors or interruptions.

Clinical outcomes vary based on individual health, anatomy, and adherence to post-operative care. DTCR is not responsible for the diagnosis, treatment plan, materials used, or results of any procedure. Disputes about clinical care must be resolved between the patient and the clinic, with reference to the consumer-protection and medical-malpractice law of the jurisdiction where the treatment occurred.

14. Limitation of liability

To the maximum extent permitted by law, neither DTCR nor Leads Agency SRL is liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the service. Our aggregate liability for any direct damages arising from the service is limited to the greater of (a) the total amount you paid us in the 12 months preceding the claim (zero, for patients), and (b) US$100. Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the minimum amount permitted by law.

15. Indemnification

If you are a clinic, you agree to indemnify and hold harmless DTCR and Leads Agency SRL from any claim arising from (a) your provision of dental services to a patient, (b) any information, photo, or credential you submitted to DTCR that turns out to be inaccurate, (c) your handling of patient data shared with you through the platform, including patients you imported. This indemnification covers reasonable attorney’s fees and is not capped.

16. Governing law and disputes

These Terms are governed by the laws of Costa Rica, without regard to conflict-of-laws principles. The courts of San José, Costa Rica have exclusive jurisdiction over any dispute, except where prohibited by mandatory consumer-protection law in the user’s home jurisdiction.

If you are a consumer in a jurisdiction whose law does not enforce a foreign forum selection, you may bring a claim in your home jurisdiction. Nothing in this section deprives you of any consumer-protection right that you cannot waive by contract.

17. Changes to these Terms

We may update these Terms as the service evolves. The “Last updated” date at the top reflects the most recent change. If a change is material, we will notify registered users by email and through a prominent banner on the site. Continuing to use the service after the change takes effect means you accept the updated Terms.
